Uniform Civil Code: A Step Toward One Nation, One Law

India has been struggling with the idea of ​​Uniform Civil Code (UCC) for a long time whereas India is a country full of diversity and unity in diversity. UCC is a law in which there is a mood to implement a uniform law for all citizens of all religions, all castes without any gender discrimination, because in today’s era there are different laws for different religions in India, so to bring unity in this, the Government of India thought of proposing a Uniform Civil Code. Under this law, an attempt has been made to make the law of all religions of India uniform. This is very easy to say but it is equally difficult to implement. There are many challenges in this, which we will see further.

What Is the Uniform Civil Code?

The aim of the Uniform Civil Code in India is to make all the laws related to marriage, divorce, inheritance or adoption and maintenance uniform. Currently, the personal laws of India are governed by the customs and religious texts of different religions such as Hindu law, Muslim personal law and Christian law. In UCC, the same law will be applicable on all citizens irrespective of their community, which ensures uniformity for all and promotes equality.

The Constitutional Vision

UCC is mentioned in the Constitution of India (Article 44), which clearly states that “The Union of India shall endeavour to secure for the citizens a Uniform Civil Code throughout the territory of India”. But still some people are making UCC a controversial issue. While the government is ready to have a comprehensive discussion with everyone, some people are distorting this law and presenting it before the public.

Potential Benefits of the UCC

Ensuring Equality

The law of Uniform Civil Code will ensure that all citizens irrespective of religion or gender will be treated equally under the law. This is especially important to address the issue of gender inequality inherent in some personal laws.

Simplification of Laws

This law will eliminate the problems and conflicts that have arisen from religious personal laws and simplify the judicial process making the legal system more efficient.

National Integration

UCC can promote feelings of national unity where all religions will have one law thereby promoting the idea of ​​“one nation one law” of India.

Gender Justice

Earlier today, personal laws of many religions have been criticized for promoting many gender discrimination practices for example triple talaq which is now abolished and unequal inheritance rights can be addressed through UCC.

Challenges and Criticism

Threat to Diversity

India’s strength lies in its unity in diversity and the UCC is often seen as a potential threat to the culture and religious practices of various communities. Opponents of the law say it could destroy the country’s pluralistic identity.

Resistance from Religious groups

Many religious communities see the UCC as an imposed law that disregards their traditions and beliefs, and hence it is strongly opposed by some religions.

Practical Implementation

Preparing a proposal to legislate a UCC acceptable to all communities and then implementing it is a huge challenge. It requires consensus and extensive dialogue among all.

Political Sensitivity

Often political parties try to religiously characterise the issue of the UCC to disrupt debate and general committee on the UCC legislation.

Global Examples of Uniform Laws

Some countries of the world, including France and Turkey, have implemented uniform civil laws which apply to all citizens of the country, irrespective of their religion, caste or gender. These countries have successfully separated religion from the country, thereby securing secular governance. However, India’s unique identity of unity in diversity makes it even more complex and requires extensive debate and customized solutions to implement this law.

Way Forward: A Balanced Approach

Gradual Implementation

UCC may be implemented in a phased manner.

Public Dialogue

The government should hold extensive discussions with communities of all religions before implementing the UCC law and take into account their concerns and beliefs.

Respect for Diversity

A UCC law should be made that respects the culture and religions of India while ensuring that it does not violate the fundamental rights and equality of citizens.

Judicial Intervention

The judiciary can also be used for the UCC law to provide uniformity in implementing this law.
